3. Can you guarantee results?

No credit repair company can legally guarantee a specific score increase. What we can guarantee is that we will dispute all inaccurate, outdated, misleading, or unverifiable information—and you get a 100% refund if no changes occur within 30–35 days (your policy).

📄 TERMS & CONDITIONS

 

1. Purpose of Agreement

This Terms and Conditions Agreement outlines the responsibilities, limitations, and legal rights of both the Client and Obsidian Mercatus LLC regarding the use of the DisputeFox (DF) credit repair portal and credit repair services.

By accessing or using the DF portal, the Client agrees to the terms listed below.

2. Service Description

Obsidian Mercatus provides credit repair services including, but not limited to:

  • Reviewing credit reports from the 3 major bureaus
     
  • Identifying inaccurate, outdated, unverifiable, or misleading items
     
  • Sending dispute letters to Experian, TransUnion, and Equifax
     
  • Sending validation requests to creditors or collectors as needed
     
  • Monitoring dispute responses and providing updates
     
  • Providing credit education and score-building strategies
     
  • Secure document upload via DF
     

Company does not guarantee a specific score increase or approval for loans, credit cards, or financing.

3. Client Portal (DisputeFox) Access

The Client will receive login credentials to DF after enrollment.
The Client agrees to:

  • Keep login information confidential
     
  • Upload required documents promptly
     
  • Review portal updates regularly
     
  • Communicate inside the portal when requested
     

Unauthorized access or misuse of the DF portal may result in suspension of services.

4. Client Responsibilities

The Client agrees to:

  1. Maintain an active credit monitoring service required by the Company
     
  2. Make timely payments for all services
     
  3. Provide accurate personal information
     
  4. Upload any letters received from credit bureaus within 48 hours
     
  5. Avoid applying for excessive new credit during the process
     
  6. Avoid actions that negatively impact the credit score (late payments, high utilization, new collections, etc.)
     

Failure to comply may delay results or affect service performance.

5. Payment & Billing

  • Credit repair services are billed as a one-time fee (unless otherwise stated).
     
  • Payment is due upon enrollment unless a payment plan or BNPL option (Buy Now Pay Later) is selected.
     
  • All payments are securely processed through approved systems.
     
  • Late or missed payments may result in suspension of services.
     

6. Refund Policy

Obsidian Mercatus maintains a transparent and results-driven guarantee:

→ 100% Refund if No Changes Occur Within 30–35 Days

If no items on the Client’s credit report reflect changes, updates, deletions, or investigations within the first 30–35 days of service, the Client may request a full refund.

Refund Conditions:

  • Client must maintain active credit monitoring the entire time
     
  • Client must upload all bureau responses within 48 hours
     
  • No new negative accounts can be added during the dispute period
     
  • Client must not have missed payments on credit accounts during the service period
     

Refunds will not be granted for delays caused by the Client or by credit monitoring inactivity.

7. No Guarantee of Outcome

Under the Fair Credit Reporting Act (FCRA), no credit repair company can guarantee:

  • A specific credit score increase
     
  • Removal of accurate and verifiable information
     
  • Approval for credit, loans, housing, or financing
     

The Company commits to lawful, persistent, customized dispute strategies.

8. Cancellation Policy

The Client may cancel at any time by:

  • Requesting cancellation inside the DF portal, or
     
  • Submitting a written request to Company email: berta@obsidianmercatus.com
     

Upon cancellation, the Client’s portal will be closed and no further services will be performed.

9. Communication Policy

All communication regarding credit disputes must occur through:

  • DF secure messaging
     
  • Company email
     
  • Scheduled phone calls
     

Text messages are for general reminders only—not official dispute decisions.

10. Document Handling & Security

All Client documents are stored and processed securely within DF’s encrypted system.
Obsidian Mercatus does not sell, share, or distribute Client data.

11. Legal Compliance

Obsidian Mercatus complies with:

  • Fair Credit Reporting Act (FCRA)
     
  • Credit Repair Organizations Act (CROA)
     
  • Fair Debt Collection Practices Act (FDCPA)
     
  • State and federal privacy laws
     

Company will never dispute accurate, verified information.

12. Limitation of Liability

Obsidian Mercatus is not responsible for:

  • Client’s past or future credit behavior
     
  • Client’s new collections, missed payments, or high utilization
     
  • Bureaus’ processing delays
     
  • Creditor decisions on disputes
     
  • Losses due to financing denial or approval outcomes
     

Company’s liability is limited to the amount paid by the Client.

13. Term of Agreement

This Agreement remains valid until:

  • The dispute process is completed
     
  • The Client cancels services
     
  • The Company terminates the account due to misuse or non-payment
     

14. Acceptance of Terms

By enrolling in services, accessing the DF portal, or submitting onboarding documents, the Client acknowledges:

  • They have read and understand these Terms & Conditions
     
  • They agree to comply fully
     
  • They voluntarily authorize Obsidian Mercatus to perform credit repair services on their behalf

Obsidian Mercatus LLC respects your privacy and is committed to protecting your personal information.
This Privacy Policy explains how we collect, use, store, and safeguard your data through the DisputeFox portal, intake forms, credit monitoring connections, and all communication channels.

2. Creditors or Collection Agencies

When validation or documentation is required.

3. Credit Monitoring Providers

To retrieve your real-time credit data securely.

4. Payment Processors

To complete billing or subscription payments.

5. DisputeFox

For secure portal access, document uploads, and dispute management.

All third parties follow strict confidentiality and data-protection standards.

Despite strong measures, no online platform can guarantee 100% protection.

  • Keep your DF login credentials confidential
     
  • Upload bureau letters within 48 hours
     
  • Maintain active credit monitoring
     
  • Avoid sharing private portal data with third parties
     

Failure to follow these steps may delay dispute progress or affect results.

8. Data Retention

We retain client data for:

  • As long as your account remains active
     
  • A minimum of 12 months after service completion
     
  • Longer if required for legal or regulatory purposes
     

After this period, all files are securely archived or deleted.

9. Cookies & Tracking (If Used on Website)

If you place this policy on a website, it must include:

  • Basic cookie tracking
     
  • Analytics data (if installed)
     

DisputeFox itself does NOT use marketing cookies for clients.

10. Minors

We do not knowingly offer credit repair services to individuals under 18.
Any minor attempting to enroll will be denied service.

11. Legal Compliance

We comply with:

  • FCRA (Fair Credit Reporting Act)
     
  • FDCPA (Fair Debt Collection Practices Act)
     
  • CROA (Credit Repair Organizations Act)
     
  • State privacy laws
